HOMOSASSA LODGE

 

GUESTS LIABILITY AND INDEMNIFICATION AGREEMENT

{hereinafter referred to as Guest(s)). GUEST has been given permission to come upon the home located at 5900 Hellsgate Island, Homosassa, Florida 34448 (hereinafter referred to as the Owners Premises) operated by Homosassa Lodge LLC (hereinafter referred to as "OWNER").

 

Guest acknowledges and understands that no warranty, either express or implied, is made by the Owner as to the condition of the Owners Premises. Guest assume full responsibility for injury to myself and (if applicable) my family members, and further releases and discharges Homosassa Lodge LLC for injury, loss or damage arising out of my family's (or third parties) use of or presence upon the facilities of Homosassa Lodge LLC, 5900 Hellsgate Island, Homosassa, Florida, whether caused by the fault of myself, my family or other third parties.

 

GUEST INDEMNIFIES AND RELEASES OWNER AND HOMOSASSA LODGE, LLC, FROM ALL LIABILITY.

 

I agree to pay for all damage to the facility caused by my or my family's negligent, reckless or willful actions.

 

I acknowledge any risks involved during my stay. These include but are not limited to: snake bite, insect bite, animal bite, slipping, falling or tripping, swimming, getting in and out of boat, running into objects. Guest agrees to observe the following.

 

• No swimming - there are sharp oyster shells underwater.

• No walking or fishing outside of sea wall. There are sharp oyster shells, holes, and uneven surfaces.

• Exercise caution while walking on the island. This is a natural environment (rock base) and you could encounter holes, uneven surfaces or sharp rocks or rubble.

• Exercise caution when walking near spiral metal staircase - there are sharp corners on treads that could cause injury. Exercise caution when treads are wet.

• No leaning against, sitting on or standing on railings on the observation deck.

• Limit of 4 people on observation deck at one time.

• Beware of spiders, scorpions and other poisonous insects.

• Beware of snakes.

• Beware of wild animals.

• Exercise caution while walking on deck of screened dock or inside screened grill area.

• Surface material could become slippery when wet.

• Use handrails while using floating dock ramp. Navigate ramp one person at a time.

• Exercise caution while standing on floating dock - it moves up and down with waves.

• Do not drink water from any faucet, hose or tap.

• Do not brush teeth with water from any faucet, hose or tap.

• Use bottled water for general drinking water, cooking and brushing teeth.

• Exercise caution on metal dock.

• Do not lean on any railings on decks, stairs or balcony

 

• Exercise caution on sidewalks - there could be uneven areas. GUEST swears that GUEST is participating voluntarily, and that the above risks are clear to GUEST. Additionally, GUEST(s) do not have any conditions that will increase the likelihood of experiencing injuries while being a GUEST on OWNERS PREMISES. GUEST will also make every effort to obey safety precautions as listed in writing, posted and as explained to me verbally. GUEST will ask for clarification when needed.

 

BY SIGNING THIS AGREEMENT, I AGREE TO HOLD HOMOSASSA LODGE, LLC ENTIRELY FREE FROM ANY LIABILITY, INCLUDING FINANCIAL RESPONSIBILITY FOR ANY INJURIES INCURRED, REGARDLESS OF WHETHER INJURIES ARE CAUSED BY NEGLIGENCE. BY SIGNING BELOW, I FORFEIT ALL RIGHT TO BRING A SUIT AGAINST HOMOSASSA LODGE, LLC, FOR ANY REASON.

 

As used in this release agreement, the term Guest/Guests/Third Parties, will include any minors in the Guests care while on the Owners Premises. All Guests who bring minors understand the Owner is not responsible for the care or safety of minors. The Guests who bring minors onto the Owners Premises assume the responsibility for watching and caring for the minors safety and guarding against hazards at all times.

 

GUEST HAS READ THIS DOCUMENT AND UNDERSTANDS IT. HE/SHE IS SIGNING IT FREELY AND VOLUNTARILY.

 

PLEASE NOTE: HOMOSASSA LODGE REQUIRES EACH GUEST/INDIVIDUAL STAVING AT THE LODGE TO SIGN AND RETURN THIS INDEMNITY WAIVER.

 

PRIMARY RENTER MUST FILL OUT AND RETURN RENTAL REGISTRATION LISTING NAMES AND EMAIL ADDRESSES OF ALL GUESTS.
